1. Acceptance of Terms
These Terms and Conditions constitute a legally binding agreement between you and Cove Finance regarding your use of our financial education services and website. By enrolling in our programs, accessing our website, or otherwise engaging with our services, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you should not use our services or website. Your continued participation in Cove Finance programs indicates your ongoing acceptance of these Terms as they may be updated from time to time.
These Terms are governed by the laws of Malaysia and the courts of Sabah shall have exclusive jurisdiction over any disputes arising from or related to these Terms or your use of our services.
2. Definitions
"Cove Finance," "we," "us," or "our" refers to Cove Finance, a financial education provider operating in Kota Kinabalu, Sabah, Malaysia.
"Services" refers to all financial education programs, workshops, consultations, materials, and related educational offerings provided by Cove Finance.
"Programs" refers specifically to the Smart Spending Framework, Insurance Portfolio Review, and Retirement Transition Workshop, along with any future educational programs we may offer.
"Participant" or "you" refers to any individual who enrolls in, attends, or participates in Cove Finance programs or services.
"Materials" refers to all educational content, documents, frameworks, templates, and resources provided as part of our programs.
3. Eligibility and Registration
Participants must be at least 18 years of age to enroll in Cove Finance programs. By registering for our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this binding agreement.
Program enrollment requires completion of our registration process, which includes providing accurate and complete information about yourself, including name, contact details, and any other information requested during registration. You are responsible for maintaining the accuracy of your information and notifying us promptly of any changes.
We reserve the right to refuse enrollment to any individual at our discretion, including if we determine that a program is not suitable for their needs or if enrollment would exceed maximum program capacity.
4. Program Enrollment and Fees
Program fees are specified at the time of enrollment and must be paid in full before program commencement unless alternative payment arrangements have been agreed upon in writing. All fees are stated in Malaysian Ringgit (RM) and are subject to applicable Malaysian taxes.
Once enrollment is confirmed and payment is received, your place in the program is reserved. We accept payment via bank transfer, credit card, or other methods as specified during the enrollment process. Payment processing is handled through secure third-party payment processors.
Program fees cover all session attendance, materials provided, educator guidance during scheduled sessions, and any specified deliverables. Fees do not include any costs associated with implementing recommendations, purchasing financial products, or engaging additional services beyond the program scope.
We reserve the right to modify program fees for future offerings. However, fee changes will not affect enrollments that have already been confirmed and paid.
5. Cancellation and Refund Policy
If you need to cancel your enrollment, you must notify us in writing via email to [email protected]. The following refund policy applies:
More than 14 days before program start: Full refund minus a RM 100 administrative fee.
7 to 14 days before program start: 50% refund of program fee.
Less than 7 days before program start: No refund available.
After program commencement: No refunds for any reason, including non-attendance at subsequent sessions.
In the event that Cove Finance cancels a program for any reason, participants will receive a full refund of all fees paid. We are not responsible for any travel, accommodation, or other incidental expenses you may have incurred in connection with program attendance.
Refunds, when applicable, will be processed within 14 business days of receiving your cancellation request and will be returned using the original payment method unless otherwise agreed.
6. Participant Responsibilities
As a program participant, you agree to:
Attend Scheduled Sessions: Arrive on time for all program sessions and participate actively in group activities and discussions. While we provide session summaries for missed sessions, consistent attendance is essential for optimal learning outcomes.
Complete Assignments: Engage with between-session exercises, reflections, and activities as assigned to support your learning and skill development.
Maintain Confidentiality: Respect the privacy of other participants by not sharing personal information or circumstances discussed during group sessions outside the program environment.
Behave Respectfully: Treat educators and fellow participants with respect, courtesy, and professionalism. We maintain a collaborative learning environment and expect all participants to contribute positively.
Use Materials Appropriately: Program materials are provided for your personal educational use only and may not be reproduced, distributed, or used for commercial purposes without our written permission.
7. Educational Nature of Services
Cove Finance provides financial education services only. We do not provide financial advice, sell financial products, or recommend specific financial institutions, products, or investments. Our programs are designed to help you develop your own financial understanding and decision-making capability.
Information shared during programs is for educational purposes and should not be construed as financial, legal, tax, or investment advice. We encourage you to consult with qualified professionals regarding specific financial decisions appropriate to your individual circumstances.
While our educators hold recognized Malaysian financial planning qualifications, the educator-participant relationship is educational rather than advisory. Educators provide guidance on applying financial concepts and frameworks but do not make decisions on your behalf or recommend specific actions you should take.
Program content reflects current Malaysian financial regulations and market conditions as of program delivery date. However, financial markets, regulations, and products change over time, and participants are responsible for verifying current information when making financial decisions after program completion.
8. Intellectual Property
All content, materials, frameworks, templates, and educational resources provided through Cove Finance programs are our intellectual property and are protected by Malaysian and international copyright laws. This includes written materials, presentation content, frameworks, templates, and any other educational content we create and deliver.
Upon enrollment, you receive a limited, non-exclusive, non-transferable license to use program materials for your personal financial education purposes only. You may not copy, reproduce, modify, distribute, sell, or commercially exploit any program materials without our prior written consent.
You retain ownership of any personal documents, information, or materials you share with us during programs. By sharing these materials, you grant us permission to use them during program delivery for educational purposes, including discussing them during sessions and using them to provide personalized guidance.
9. Disclaimers and Limitations of Liability
Educational Service Disclaimer: Cove Finance programs are provided on an "as is" basis. While we strive to provide high-quality educational content, we make no warranties or representations regarding specific outcomes, results, or financial improvements you may experience from participating in our programs.
No Guarantee of Results: Financial outcomes depend on numerous factors beyond our control, including individual circumstances, market conditions, and personal decisions. We do not guarantee any particular financial results or improvements from program participation.
Limitation of Liability: To the maximum extent permitted by Malaysian law, Cove Finance shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in our programs or use of our services. Our total liability for any claim related to our services shall not exceed the amount you paid for the specific program giving rise to the claim.
Third-Party Actions: We are not responsible for any actions taken by financial institutions, insurance companies, or other third parties with whom you choose to engage following program completion. Any such relationships are entirely between you and those parties.
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your personal data in accordance with the Malaysian Personal Data Protection Act 2010.
By agreeing to these Terms, you also consent to the data processing practices described in our Privacy Policy.
11. Changes to Programs and Terms
We reserve the right to modify program content, schedules, locations, or delivery methods as necessary to maintain quality and adapt to changing circumstances. Material changes affecting enrolled participants will be communicated in advance where possible.
We may also update these Terms and Conditions from time to time. When we make material changes, we will post the revised Terms on our website with an updated "Last Updated" date. For significant changes, we will provide additional notice to enrolled participants via email.
Your continued participation in programs after Terms changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you may cancel your enrollment in accordance with our cancellation policy.
12. Termination of Services
We reserve the right to terminate your participation in any program if you:
Breach these Terms or engage in conduct that disrupts the learning environment, violate the privacy or rights of other participants or educators, fail to make required payments, or provide false or misleading information during enrollment or participation.
In the event of termination for cause, no refund will be provided. We will make reasonable efforts to address concerns before termination but reserve the right to immediately terminate participation in cases of serious misconduct.
13. Force Majeure
Cove Finance shall not be liable for any failure to perform our obligations under these Terms if such failure is caused by circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, technical failures, or other force majeure events. In such cases, we will make reasonable efforts to reschedule programs or provide alternative delivery methods where possible.
14. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or related to these Terms or your participation in our programs shall be subject to the exclusive jurisdiction of the courts of Sabah, Malaysia.
Before pursuing formal legal action, we encourage you to contact us directly to resolve any concerns or disputes informally. Many issues can be resolved through good faith discussion and mutual understanding.
If informal resolution is not successful, both parties agree to attempt mediation before proceeding to litigation. The costs of mediation shall be shared equally between the parties.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
16. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any enrollment agreements, constitute the entire agreement between you and Cove Finance regarding your use of our services. These Terms supersede all prior communications, proposals, and agreements, whether oral or written, between you and Cove Finance.
